Student Code of Conduct
Due Process

III. DUE PROCESS

The social discipline system is established in accordance with the concept of due process. Due process, as used herein, consists of two parts. The first means that a student will know in advance what conduct is unacceptable and the consequences of such conduct. It requires rules and regulations of student behavior that are reasonable, clear and precise, clearly communicated, and fairly and consistently administered (substantive due process). The second part of due process means that a student will be given a statement of the charges against him/her and a fair opportunity to be heard and to present evidence before a decision is rendered (procedural due process).

All hearings are closed to the public as a protection to those charged with a violation and to those who may be witnesses.

Definitions
